1. Agreement to Terms

By accessing and purchasing from the VesperLay website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and VesperLay. If you do not agree with any part of these Terms, you must not use or make purchases from this Site.

2. Products and Purchases

VesperLay sells dresses, tops, and pants as described on the Site. All features, specifications, and prices of products are subject to change without notice. We reserve the right to discontinue any product at any time. We make every effort to display product colors and images as accurately as possible, but we cannot guarantee your screen's display accuracy.

By placing an order, you represent that you are of legal age in your jurisdiction to form a binding contract. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities, inaccuracies in product or pricing information, or suspected fraud.

3. Limitation of Liability

To the fullest extent permitted by applicable law, VesperLay, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall VesperLay's aggregate liability for all claims relating to the Site exceed the greater of the amount you paid to VesperLay in the last six months or one hundred US dollars (USD $100).

4. Intellectual Property Protection

All content on this Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of VesperLay or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

The "VesperLay" name and logo, and all related product and service names, design marks, and slogans are the trademarks or service marks of VesperLay. You are not permitted to use any of these marks without our prior written permission. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from the Site.

5. Refund & Return Policy

We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible items within 30 days of delivery for a refund or exchange, subject to the conditions below.

• Eligibility: Items must be unworn, unwashed, and in their original condition with all tags attached. Proof of purchase is required.
• Non-Returnable Items: For hygiene reasons, final sale items, underwear, and personalized items are not eligible for return unless faulty.
• Process: To initiate a return, please contact our customer service team at [email protected] to obtain a Return Merchandise Authorization (RMA) number and instructions. Returns sent without an RMA may not be processed.
• Refunds: Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed to your original method of payment within 10 business days. Shipping costs are non-refundable.
• Exchanges: We currently offer refunds only. For a different item, please process a return and place a new order.
• Damaged or Faulty Items: Please contact us immediately at [email protected] if you receive a damaged or defective product.

6. General Provisions

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
